Trademark Availability and Clearance Searches

Before adopting or filing a trademark, it is essential to conduct a comprehensive clearance search in order to identify earlier rights that could prevent registration or expose the applicant to opposition or infringement claims.

Such searches typically involve reviewing official databases maintained by the Moroccan IP office and international trademark registries.

Official databases include:

OMPIC trademark database

WIPO Global Brand Database

In practice, trademark clearance requires more than a simple database search. A legal assessment of similarity risks, likelihood of confusion and the scope of earlier rights is often necessary in order to evaluate the registrability and enforceability of the proposed mark.

Our firm regularly conducts such clearance analyses in order to help clients adopt trademarks that are both legally secure and commercially sustainable.

Trademark Registration in Morocco

Trademark protection in Morocco is obtained through registration with the Office Marocain de la Propriété Industrielle et Commerciale (OMPIC).

The application generally includes:

  • identification of the applicant

  • representation of the trademark

  • specification of goods and services under the Nice Classification

  • payment of official filing fees

  • a power of attorney when the application is filed through a representative

Online filing is available via the official platform:

https://www.directinfo.ma

From a strategic perspective, the drafting of the specification of goods and services and the definition of the filing scope are critical elements of a trademark strategy. Businesses seeking to expand internationally often benefit from structuring their filings in a manner that anticipates future geographic expansion and brand enforcement.

Duration and Renewal of Protection

Once registered, a trademark is protected for a period of ten (10) years from the filing date.

The registration may be renewed indefinitely for successive ten-year periods, provided renewal fees are paid within the prescribed deadlines.

Maintaining an active trademark portfolio often requires monitoring renewal deadlines, managing assignments and licenses, and ensuring continued use of the mark in commerce.

International Trademark Protection

Trademark protection abroad may be obtained through several mechanisms depending on the jurisdictions targeted and the applicant’s commercial strategy.

One widely used mechanism is the Madrid System for the International Registration of Marks administered by the World Intellectual Property Organization (WIPO).

The Madrid System allows trademark owners to file a single international application through their home IP office and designate multiple member jurisdictions.

Alternatively, protection may be obtained through national filings in individual jurisdictions, typically carried out through local intellectual property counsel authorized to practice before the relevant national IP offices.

In practice, international trademark protection strategies frequently combine Madrid designations with direct national filings coordinated through a network of trusted international IP professionals.

This hybrid approach allows companies to achieve both administrative efficiency and jurisdiction-specific legal precision.
